Terms and conditions of plug the jack

Object of the General Terms – Description and Right of Access

PLUG THE JACK operates infrastructures that support musical and artistic creation. Holders of an account who make a reservation with Plug The Jack obtain a right of access to Plug The Jack’s infrastructures and to the creative spaces for which a right of access is reserved. These infrastructures consist of spaces specifically designed for musical creation, podcasting, rehearsal and deejaying, as well as shared areas for meetings and collaboration. The client undertakes to comply with these rules and obligations and unreservedly accepts PLUG THE JACK’s General Terms and their annexes.

Rules and Obligations when Accessing PLUG THE JACK’s Infrastructures

You agree to comply with these General Terms each time you use our infrastructures. They may be amended by PLUG THE JACK at its sole discretion and the amended General Terms will be published on the website under “General Terms”. Your use of our infrastructures after such amendments constitutes your acceptance of them. In the event of non-compliance with the rules and obligations contained in these General Terms, fines and compensation may be claimed from you in accordance with the fines and compensation section of these General Terms. You hereby undertake to pay such fines and compensation.
These General Terms exclude the application of any of your own general terms.

Creating a Client Account, Information to Provide, and Obligations

When creating a client account on the website, each user must choose a unique password. These credentials are assigned exclusively to the user’s client account and may not be disclosed. You will also be asked to provide a valid email address (verification email).

For liability and insurance reasons, Plug The Jack must verify your identity when you create an account before you can benefit from a right of access to the studios. To carry out this verification, Plug The Jack recommends the ITSME application, which is widely used by institutions. If you do not have access to ITSME, Plug The Jack may ask you to confirm your identity by providing a photo of your identity document or passport, together with a selfie. The images and information collected in this way will be used exclusively for safety and insurance purposes, in compliance with the GDPR.

A client account may only be used in the interest of its holder.

Each user may hold only one client account. If you lose your password, you may request its recovery or replacement via the PLUG THE JACK website. If you believe that access to your client account has been compromised, that your password is no longer confidential, or that any sensitive information enabling a third party to use your client account has been compromised, you must notify us as soon as possible. You are solely responsible for the use of your client account and the consequences arising from it.

The user of the website and PLUG THE JACK’s infrastructures confirms that he or she does not use the website or client account on behalf of a third party, that any use of the client account is made by the account holder alone, and that the account holder is solely responsible for such use.

You confirm that all personal information you provide to us when creating your client account and during any subsequent exchanges is correct and kept up to date, that you are authorised to provide it to us and entitled to use it.

You confirm that the information you provide to us is correct, that you are not impersonating a third party, that you are not acting on behalf of a third party and that you are not soliciting information from a third party in order to gain access to our services and infrastructures.

PLUG THE JACK is authorised to use the data you provide in order to deliver services to you and process your payments. If you have given your consent when creating your account, PLUG THE JACK may also use your data to inform you regularly about other services it offers, promotions and information about similar services. You may withdraw this consent at any time.

In the event of non-compliance with the above provisions, PLUG THE JACK is entitled to cancel the creation of your client account or terminate it.

PLUG THE JACK is also authorised to terminate or require a new verification process for any account that has recorded no activity for at least 18 months. In such a case, prior notice will be sent to the user at the email address registered on the client account.

Conditions to Access and Use Plug The Jack’s Infrastructures

To access Plug The Jack’s infrastructures and its creation and rehearsal studios, you must be at least 16 years old and hold a valid individual client account created via the PLUG THE JACK website (www.plugthejack.com).

Access for minors under the age of 16 is only permitted in PLUG THE JACK’s buildings and infrastructures if they are accompanied by one of their legal guardians and remain under that person’s responsibility at all times. You undertake not to be accompanied by a minor under 16 on PLUG THE JACK’s premises unless these conditions are met. You and anyone accompanying you must carry an identity document while present at PLUG THE JACK.

Validating / Cancelling / Modifying a Reservation

When you reserve online, you acquire a right of access to an entertainment infrastructure for a specific timeslot; validation occurs when payment is confirmed. The reservation is confirmed after full payment and confirmation is sent by email to the address indicated in your client account. If the reservation cannot be confirmed, in particular for technical reasons, it will not be charged or it will be refunded if payment has already been made, and any pre-authorisation will be released.

Your reservation may be modified or cancelled up to 4 hours before it starts via your personal web space on www.plugthejack.com. Reservations are non-refundable. In the event of cancellation, a credit voucher equal to the value of the reservation will be added as a positive credit balance to your client account.

A reservation can no longer be cancelled or modified less than 4 hours before it starts. It begins at the scheduled time and ends at the scheduled time even if you arrive late at your studio.

PLUG THE JACK may modify or postpone any scheduled reservation for internal or technical reasons. This may also involve changing the studio and replacing it with another equivalent studio during the same timeslot. If PLUG THE JACK modifies your reservation, you will be informed by email. If PLUG THE JACK cancels your reservation, the reservation fees paid will be refunded in full.

You undertake, for yourself and all persons accompanying you, not to damage PLUG THE JACK’s equipment or indoor and outdoor infrastructures. Otherwise, you will indemnify PLUG THE JACK without limitation of cost for all damage caused and any associated indirect losses. If you notice damage, malfunctions or missing equipment when entering your studio upon arrival, you must notify us immediately; otherwise, you may be presumed responsible and PLUG THE JACK may invoice you for the repair or replacement of such equipment.

If you bring equipment to PLUG THE JACK or store it there, it remains under your sole responsibility. If you bring your own equipment, you undertake to use only devices that comply with all applicable electrical and safety standards, are properly maintained and present no risk during use. You will be held responsible for any damage or interference caused by the use of your equipment at PLUG THE JACK.

Prevention, Security, Video Surveillance and Fire Protection

PLUG THE JACK’s premises contain essential systems designed to protect the premises against theft, fire, accidents and damage to its equipment and infrastructures. These systems include, in particular, surveillance cameras located in common areas and in each studio, fire detection systems, emergency lighting systems, alarms and anti-theft systems, this list not being exhaustive. By accepting these General Terms, you confirm that you accept the presence of each of these systems for its intended use.

You must refrain from any action, manipulation, partial or total obstruction of, or interference with, PLUG THE JACK’s security systems. In the event of non-compliance with these rules, PLUG THE JACK is authorised to claim a flat-rate fine for failure to comply with basic safety rules, and you will be held liable and must indemnify PLUG THE JACK for all costs and consequences, including damage caused by third parties, resulting in particular from such non-compliance and its consequences for the safety of the installations.

You will ensure that these rules are respected by all persons accompanying you and you act as guarantor for them. You declare that you and the persons accompanying you have read the emergency procedures to be followed in the event of evacuation and the safety rules applicable within PLUG THE JACK’s infrastructures.

If you observe any behaviour or acts that are or appear to be contrary to PLUG THE JACK’s General Terms, you undertake to inform us as soon as possible.

Accordingly, you acknowledge that you are responsible for the sound levels in the studio and will avoid maintaining high sound levels for prolonged periods.

PLUG THE JACK reserves the right to take any measures it deems appropriate to maintain tolerable sound levels, and no claim may be brought against it in this respect.

Subject to mandatory legal provisions to the contrary, PLUG THE JACK is subject only to a best-efforts obligation and shall not be liable:

-         For losses or damage, whether material or immaterial, physical or moral, commercial or otherwise, direct or indirect, that you may suffer under this agreement or its performance in whole or in part, whether you are a consumer within the meaning of Article I.1, 2 of the Belgian Code of Economic Law or a business.

-         For any malfunction of its facilities, breakdown or resulting consequences where such event is beyond its control, except in the event of gross negligence by PLUG THE JACK or its representatives or intentional misconduct on their part.

- Notwithstanding any other provision of this agreement, PLUG THE JACK shall not be liable to you or the persons accompanying you for any direct, indirect or consequential loss or damage, or any economic loss, arising from the use of the infrastructures or tools provided by PLUG THE JACK.

Each consumer is deemed to have taken out family civil liability insurance if he or she is a consumer within the meaning of Article I.1, 2 of the Belgian Code of Economic Law, or civil liability insurance if acting as a business.

Nevertheless, PLUG THE JACK will take out civil liability insurance and will agree, without any prejudicial admission of liability, to submit a claim to its insurance company at your express request if the insurer’s conditions for intervention are met. In all circumstances, compensation for any damage you may suffer will be limited to the amount of compensation provided for in the insurance policy and accepted by the insurance company, without PLUG THE JACK being required to pay any additional amount.

Notwithstanding any other clause of this agreement, PLUG THE JACK shall under no circumstances be liable for any failure to perform any of its obligations under this agreement due to an event of force majeure.

Any claim for any defect or for compensation must be submitted in writing within 8 days from the end of the studio occupancy, failing which the claim will be time-barred.

Indemnification

You undertake to indemnify us and all our representatives, staff members, officers and indirectly associated parties, including for all direct and indirect costs, expenses and loss of profit incurred by PLUG THE JACK if you or any person accompanying you fails to comply with these General Terms, commits fraud or violates the law.

Certain compensation amounts or flat-rate fines are provided for in PLUG THE JACK’s House Rules. These are minimum amounts, and PLUG THE JACK is entitled to claim higher amounts covering full compensation for its loss.

Modification, Suspension and Termination of Your Access or Contract

Without prejudice to any other rights and remedies available to us under these General Terms or the law generally, we reserve the right to suspend or terminate your access to and/or use of the website, digital tools or PLUG THE JACK infrastructures immediately after becoming aware of any breach or potential breach by you of this agreement.

In addition, in the event of non-compliance with the General Terms, fraud, attempted fraud, legitimate doubt or violation of the law, PLUG THE JACK may at any time and without notice suspend or terminate your account and your access to its infrastructures.

PLUG THE JACK reserves the right to restore your access to its infrastructures and your client account once any doubt has been resolved. It reserves the right to ask you to provide any useful information necessary to resolve such doubt.

PLUG THE JACK reserves the right to modify, cancel or suspend any reservation or client account for any reason whatsoever.

General Terms Applicable to Credit Packs and Promotions

Credits obtained when purchasing promotional packs (hereinafter “credit packs”) are credited to the client’s account and remain valid for as long as the client account remains active, with no expiry date until they are used.

Credits can be used in all studios and at all addresses/cities where Plug The Jack operates studios.

The number of credits available on the client account is visible on www.plugthejack.com under the “Invoices and credits” tab.

Credit packs are non-refundable, in whole or in part, if unused.

Credits available on a client’s account may be used at any time. They may be combined with other promotions or special offers proposed by Plug The Jack.

If the client account is terminated, all remaining credits on the account will be forfeited.

Credits are not transferable between different client accounts.

Purchasing credit packs implies full and unconditional acceptance of Plug The Jack’s General Terms.

Plug The Jack reserves the right to adjust its rates (inflation, increases in operating costs, etc.). Changes to the rates of Plug The Jack’s studios will not change the number of credits available on client accounts.

Certain promotional offers from Plug The Jack provide preferential rates for the grouped purchase of a defined number of studio hours. To benefit from these preferential rates, the hours must be purchased simultaneously in a single transaction and used during one continuous session in the same studio. Eligibility for the discount requires compliance with both conditions.

If the desired number of hours is unavailable at the time of the transaction and the client chooses a smaller number of hours and later decides to add further hours or use another studio, the promotion will not apply. The offer is strictly reserved for one-time purchases and unified sessions, thereby ensuring a consistent experience and optimal use of our facilities.

Late Payment Penalty

In the event of non-payment of any amount on the due date, the amount due will, by operation of law and without formal notice, be increased by interest at 1% per month from the due date, without prejudice to the application of the Belgian Law of 2 August 2002 on combating late payment in commercial transactions. In addition, and without prejudice to such late-payment interest, flat-rate compensation equal to 15% of the amounts due, with a minimum of €125, will be payable by operation of law as a penalty clause.

Jurisdiction and Applicable Law

This agreement is governed by Belgian law. Any dispute, on any grounds whatsoever, shall fall within the exclusive jurisdiction of the courts of the Brussels judicial district.

Validity and Scope

The invalidity of any provision of these General Terms shall not result in the invalidity of the agreement. The court will replace the invalid provision with a provision that best reflects the common intention of the parties.

The agreement binds the parties and their heirs and successors.
